INFORMATION ON PROPERTY FORECLOSURE SALES

  • Sales will be held as necessary. Sheriff foreclosure sales are held the first Tuesday of each month, excluding general election days, by public auction. The time and place for the auction is published in the Notice of Sheriff's Sale.
  • A list of properties for sale can be obtained at the time sale is published.
  • Sales are advertised through the local newspaper and posted at the county courthouse.
  • Lists of interested buyers are not maintained for advance notice.
  • Sales are one day only.
  • Registration of bidders is required. Bidders must have no delinquent taxes within the district. Sheriff sale requires attendance; therefore, purchase via U.S. Mail is not possible.
  • Method of payment is by cash or certified funds. All sales at Sheriff's sale require full payment at bid acceptance.
  • Deeds are prepared after the sale, recorded with the County Clerk and forwarded to purchaser.
  • State statutes and rules regarding the tax sale can be obtained from the Comptroller of Public Accounts, Property Tax Division, P.O. Box 13528, Austin, TX 78711-3528.
  • The owner of real property sold in a tax sale has certain rights to redeem that property. The redemption period is until the second anniversary from the date the Sheriff's deed is recorded for (a)property which was the residence homestead of the owner, (b) land that was designated as agricultural use when the suit was filed, or mineral interests. The redemption period for all other property types is six months from the Sheriff's deed recording date.
  • Property will be sold in its current condition, without any warranty as to the condition or title, either expressed or implied, sellers encourage bidder to satisfy himself, prior to bidding on the property, as to any right of redemption, current occupant, title defects, etc., through consultation with bidder's attorney. Sellers will provide the successful bidder with a "Sheriff's Deed" (Sheriff's sale) or "Tax Deed" (tax re-sale), and bidder acknowledges that the sellers are not able to make any representations whatsoever to bidder.
  • Properties struck off to a taxing entity may be available for immediate purchase. Contact the Tax Assessor/Collector for more information.
